Course Description: Healthcare managers are confronted with new and complex legal questions and issues.  Through case studies, students examine legal issues in healthcare law.  The role of public policy is considered as a key dynamic in the legal environment of healthcare.

 

Prerequisites:  None

 

Textbooks:  Regulation of the Healthcare Professions, Jost 1997

                    The American Bar Association Guide to Workplace Law

 

Statement of Plagiarism:

If an instructor or other Calumet College of St. Joseph personnel find that a student has plagiarized or been involved in another form of academic dishonesty, the instructor or other personnel may elect to bring the matter up for judicial review. The maximum penalty for any form of academic dishonesty is dismissal from the College. The procedures for judicial review are listed under the section of CCSJ handbook that addresses student grievances.

 

Calumet College of St. Joseph adheres to citation guidelines as prescribed by the particular discipline (i.e., MLA, APA, Chicago Manual of Style or Turabian.).  All of these guidelines are available in the Calumet College of St. Joseph library or bookstore.  These texts outline how to cite references from a variety of sources, including electronic media.

 

Withdrawal from Classes Policy:

Degree Completion Division (DCD) students should consult the DCD Student Handbook for information on DCD withdrawals.

 

An official withdrawal is recorded as a "W" grade on the student's transcript. Dropping a

course without written permission automatically incurs an "F" grade for the course (see

Refund Schedule).

 

Class Policy for Assignments:  Students will be given ample time to work on their assignments.  All assignments are to be turned in at the beginning of the class period they are due.  NO LATE ASSIGNMENTS WILL BE ACCEPTED.

 

 

 

Class Policy on Attendance:  Students are expected to attend all class sessions.   If a student must miss a class session they are expected to contact the instructor prior to the class session.  If a student misses more than one four-hour class session they will be administratively withdrawn from that class.

 

Course Objectives / Learning Outcomes:

 

1.       Students will be able to demonstrate knowledge of employment law as it relates to the process of hiring and terminating employees.

 

2.       Students will have a thorough understanding of employment discrimination based on the Civil Rights Act Title VII, the American with Disabilities Act and the Age Employment Discrimination Act. 

 

3.       Students will demonstrate knowledge of regulation and discipline of healthcare providers.

 

4.       Students will be able to demonstrate knowledge of Tort law as it relates to medical negligence, intentional torts, federal initiatives concerning compliance programs, JCAHO requirements for reimbursement and reporting of sentinel events.

 

 

Assessment:

To be discussed the first night of class.

 

Grading Scale:

A: 100% - 90%,  B:  89% - 80%,  C:  79% - 70%,  D:  69% - 60%,  F:  Below 69%

 

Format for Written Assignments:

Students will adhere to the American Psychological Association Guidelines (APA) style for all papers.

All reading assignments are to be done prior to class.

Written Assignment # 1:

Write a 5 page (cover and bibliography not included), APA style, font size 11 and margins ˝”, double spaced on one of the following topics:

1.                   Healthcare professionals and self regulation, who does it benefit

2.                   The advantages and disadvantages of federal standards for healthcare professionals

3.                   Detecting, monitoring and managing the impaired healthcare worker

 

Written Assignment # 2:

Write a 5 page report as above on one of the following topics:

1.                   Patient Bill of Rights

2.                   Internal Quality Assurance

3.                   Regulation of physicians and controlled substances

 

Be sure to support your arguments with necessary documentation.

 

Papers turned in late will be downgraded.

 

Re-writes for poor grades may be allowed at the instructor’s discretion.
